Court Dismisses Gambling Advert Lawsuit
[Thursday, December 11, 2008]
The legal case against Google and Yahoo! for showing online casino adverts next to search queries has been dismissed by a California court.
California Superior Judge Kramer has presented his verdict that these search engines were not liable because of federal legislation that protects websites from liability for advertisements by other companies. Judge Kramer also ruled that there was no reason to pursue this as they had stopped advertising online casinos in the US.
Judge Kramer wrote: 'Without comment on whether (advertising online casinos) in the past was wrongful, it is clear ..... that each defendant has ceased such sponsorship'.
The case goes back to 2004, when two Californian filed lawsuits against Yahoo! and Google due to losing significant sums of money on online casinos, one of these had lost $100,000 gambling online. The two claimants contented that the advertising of online casinos violated state law. The court had earlier ruled that they would only be able to press for damages if they had won the case.
