Alternative Gaming Legislation Proposed by Bwin [Friday, November 28, 2008]

Austrian Finance Minister Wilhelm Molterer's gambling legislation proposal has received widespread criticism. Online gaming company Bwin has reacted by commissioning its own legal experts to draw up and present an alternative proposal for gaming legislation to the Finance Ministry.

Molterer's proposal states that private online gambling operators will still be banned from providing their online gaming services in Austria. Win2Day and Casinos Austria's online gaming site will still be able to continue operating and thus will remain a monopoly. This also prohibits financial institutions from processing any payments to an unauthorized operator.
Molterer's current draft has received criticism from Austria and other countries as favoring the Casinos Austria monopoly which is in defiance of European Community law. The draft is believed to allow a gaming machine license that could only be won by Novomatic. With regards to amending the Austrian gambling laws, it is claimed that the Bwin management are baffled that they were not informed about the discussions that took place.
The online gaming company announced that if the legislation will be amended for the purpose of opening the market to other gaming operators, Bwin would be more than willing to pay taxes in Austria on locally generated income. Mr. Teufelberger, one the Chief Executive Officers of Bwin, stated that there have been many verdicts from courts in Austria that have supported the belief that the current prohibition on online gaming is a violation of the European legislation. He also added that the proposal as its stands would be a breach of European law and if the national Council approves the Finance Minster's draft as it is then there could be a possibility that Bwin might discontinue the development of new technologies within Austria. Bwin currently has 800 employees and several hundred IT developers based in Vienna. This move would be a drastic step that would put into question the future of these employees.
